I'm working with a partner's candidate. This candidate just gave me a couple of names of additional potential candidates I might want to contact. I'm assuming these new candidates are considered mine, correct?

Great question! There are a couple of things at play here. First, we refer to this as "secondary sourcing" - when you solicit, or a partner's candidate freely volunteers, the names of additional potential candidates (or potentially additional roles to fill).
- The candidate-side recruiter can designate 'no secondary sourcing' on any candidate, which means you may not solicit referrals from that partner's candidate.
- Any new candidates obtained via referral from a partner's candidate belong to that candidate. You must turn over all the information you received about the new candidates to your partner. These are considered split candidates, with a fee owed to your partner in the event you place them.
The 'but for' rule comes into play with this question: You would not have learned of these new candidates without your partner sharing the first candidate; therefore, a split is owed.
