Dear Nicky,

Another member's former recruiter contacted me recently wanting to work on split business. Is this OK?

Following the Rules in Forester

Dear Forester,

Great question! NPAworldwide owners have established a number of policies regarding former recruiters:

  • Members may not HIRE another member's former recruiter/employee for at least one year after that recruiter's departure UNLESS the affected owner gives written permission for such a hire to occur.
  • Brokerage is due on split placements made between a member and any person who in the previous 12 months has been employed or contracted to a member. Brokerage is to be collected by the member (irrespective of whether they are an importer / job-side or exporter / candidate-side) and remitted to NPAworldwide in accordance with standard procedure.
  • If a member owner has reservations or concerns about a prospective member who was a partner, employee, or contractor of that firm and the prospective member's date of departure is less than 12 months from the date of application, that prospective member must re-apply after a full 12 months have passed.

These policies are in place to protect a member's financial and proprietary interests, and also to maintain an atmosphere of trust and integrity between partners. Thanks for checking.

Nicky
