Dear Nicky,

A recruiter who used to work for an NPAworldwide partner has contacted me about some new split placement opportunities. This has not happened to me before, and I'm not sure what the rules are. Is it OK for me to make splits with a partner's former recruiter?

Dear Uncton,

Member-owners invest heavily in training and developing their staff. While turnover is part of the business, it is disruptive and expensive. Of course, you are welcome to run your businesses as you see fit; however, no protection (indemnification) is available to members doing work with former employees of a member firm. As a further reminder, brokerage is due on split placements made between a member and any person who in the previous 12 months has been employed or contracted to a member. Brokerage is to be collected by the member (irrespective of whether they are an importer / job-side or exporter / candidate-side) and remitted to NPAworldwide in accordance with standard procedure.

Understand your risk and financial obligations before embarking upon splits with any member's former recruiter.
